Our lawyers have extensive experience appearing before the Malaysian courts at all levels across trial and appellate proceedings and handling a broad range of civil and commercial disputes. Our practice is grounded in conventional civil and commercial litigation, while extending into disputes arising from highly technical, regulated and rapidly evolving industries.
We approach disputes with a clear understanding that litigation is ultimately a means to an end. The appropriate strategy must therefore be informed not only by the legal merits of a claim or defence, but also by the client’s commercial objectives, risk appetite and the wider consequences of the dispute.
From the outset, we identify the issues that are likely to determine the outcome, assess the evidential and legal position, and consider the available avenues for resolution. Where an early resolution is commercially advantageous, we seek to achieve it without compromising our client’s position. Where proceedings are necessary, we pursue them with the same degree of preparation, discipline and strategic focus.
Our advice is directed towards giving clients a realistic assessment of their position including the strengths, weaknesses, risks and potential outcomes so that decisions can be made with clarity and confidence.
Our disputes practice is complemented by sector-focused experience in construction and projects, banking and financial institutions, insurance, technology and AI, employment and industrial relations, private wealth and property. This enables us to approach disputes not merely as legal claims, but within the technical, regulatory and commercial environment in which they arise.
We believe that an effective disputes practice requires more than legal expertise alone; it requires an understanding of the industries, businesses and projects that sit behind the dispute.
Our objective is to understand not only the dispute itself, but the business, project or industry from which it arises. This enables us to approach each matter within its proper commercial context, identifying the issues that are legally significant, understanding those that are commercially consequential, and developing strategies that are responsive to both.
Advising and representing companies, shareholders and directors in disputes arising from the ownership, management and governance of companies. Our experience includes shareholder and directors’ disputes, breaches of directors’ duties, minority shareholder claims, oppression and unfair prejudice, derivative actions, and disputes arising from mergers and acquisitions, corporate restructurings and other corporate transactions.
Advising and representing parties across the full spectrum of commercial and contractual disputes, including claims arising from breaches of contract, sale and purchase agreements, joint ventures, partnerships and other commercial arrangements. Our experience also extends to disputes involving non-payment and debt recovery, misrepresentation, repudiatory breaches, termination and other contractual remedies.
Advising and representing individuals, companies and organisations in defamation proceedings, whether as claimants or defendants. Our experience covers both libel and slander, including defamatory publications disseminated through traditional media, digital platforms, websites and social media, as well as related claims involving the protection of reputation and injunctive relief.
Acting in disputes involving fraud, fraudulent and negligent misrepresentation, dishonest conduct, breach of trust and other forms of financial misconduct. Where appropriate, we pursue urgent and strategic remedies including asset tracing and recovery, freezing injunctions, proprietary claims, disclosure orders and other interlocutory relief aimed at preserving assets and preventing dissipation.
Advising and representing companies, creditors, shareholders, liquidators, judicial managers and other stakeholders in contentious insolvency and restructuring matters. Our practice includes winding-up disputes, challenges involving insolvency office-holders, disputes between companies and liquidators or judicial managers, recovery actions and other litigation arising in the context of corporate distress and restructuring.
Representing clients in disputes concerning ownership, title and interests in land and property, including claims relating to beneficial ownership, land transactions, boundary and title issues, land acquisition and other contentious property matters. We also advise on the strategic resolution and enforcement of property-related claims where the underlying dispute involves contractual, corporate or commercial considerations.
